Capella University Forced To Admit That They Have VIOLATED THE LAW!

In a stunning letter to Capella's feeble President, Michael Offerman, dated July 21, 2005 from a Federal Law Enforcement Agency, Capella University has been caught in the act! Specifically, Greg Thom, Capella's Chief Counsel, Vice President, Secretary, Civil Rights Attorney, Liar Extraordinaire, etc., etc. has been forced to disclose the fact that the University has refused to provide documents demanded by a student as required under the Family Educational Rights and Privacy Act (FERPA)! While a significant portion of that investigation is still underway (because it appears as if Capella University has been refusing to cooperate), we're providing just a very small sample of what's to come!

In yet another attempt to weasel his way out of the fact that he has, personally, engaged in illegal activities, Greg Thom provided a written response as part of a pathetic effort to cover his actions. (No wonder he has consistently refused to abide by Capella's official policy to respond to anything in writing!) As with cowards and girly men everywhere, Greg Thom tried to pass the buck! Considering that he is also Capella's Chief Counsel it's rather shocking, to say the least, that he had to resort to outside counsel in the first place. But, then again, he's going to need someone to represent him in the very near future!

In his letter to a Federal Law Enforcement agency, dated March 7, 2005, Greg Thom stated:

Based on advice we have received from outside counsel, I believe our logic was flawed in thinking that since ASC consideration of [the Student's] case was still in process at the time we responded to [the Student], we were not required to disclose documents at that time. Again, to the extent any such documents exist, they will be forwarded to [the Student].

Give us a BREAK! Greg Thom's (and Capella's) "logic was flawed"?! The fact is, Greg Thom and Capella University have violated the law! Not only that but Greg Thom has, once again, displayed what an incredible liar he is! The excerpt listed above came from a letter sent to Michael Offerman dated July 21, 2005. In turn, Greg Thom's stupid comment about his "flawed logic" came from a letter dated March 7, 2005. While the time between these two letters is nearly five months, neither Greg Thom, nor anyone else from Capella University has sent a single page to the student. Look's like Michael Offerman, Greg Thom, et al are in deep doodoo! We're glad for one thing, though - we have now added a new word to our glossary of "Capella-Speak" terms - "flawed logic."

UPDATE! (August 2, 2005) - in a stunning act to minimize their violation of the FERPA, Capella University has been forced to turn over some of the records mentioned above. As noted, the student demanded these records more than a year ago and Greg Thom promised a Federal Law Enforcement Agency that he would produce them five months ago. Under FERPA, Capella had forty-five days, from the date of request to produce them. Again that was more than a year ago!

We're certain that this occurred because Capella's feeble President, Michael Offerman, just received from the United States Department of Education to produce those records, and to provide a detailed list of records they have but have refused to turn over. Of course, there are many, many other documents and materials that they continue to refuse to provide but, the fact remains, Capella University and Greg Thom have violated FERPA!

One last thing - many of the documents mentioned by Greg Thom were provided to the United States Department of Education, Office for Civil Rights. So . . . if Capella destroyed them, the fireworks will only be that much bigger! Perhaps Greg Thom's next job will be representing Enron - he certainly fits the profile!
